Tolak hudud, tolak hak Muslim
Zainal Abidin Nor | September 27, 2011 Mereka yang menentang hukum hudud bererti mereka telah menafi dan mencabuli hak asasi masyarakat Islam.

PETALING JAYA: Golongan yang menolak pelaksanaan hukum hudud telah menolak hak asasi manusia, menafikan hak masyarakat Islam di negara ini.

Ahli Jawatankuasa Kerja Pusat, Persatuan Cina Muslim Malaysia (MACMA), Haji Kamal Koh berkata, mereka yang menentang hukum hudud bererti mereka telah menafi dan mencabuli hak asasi masyarakat Islam.

“Kenapa kita mesti mengorbankan hak kita, mengenepikan hak kita semata-mata untuk memenuhi kehendak orang lain,”? soal beliau ketika diwawancara oleh FMT mengenai isu hudud yang menjadi polemik dewasa ini.

Kamal Koh berkata, dalam negara demokrasi, kuasa terletak pada rakyat majoriti dan pendapat majoriti harus didengar dan diikut. Di negara ini, orang-orang Melayu dan Bumiputera yang beragama Islam merupakan penduduk majoriti.

“Seharusnya undang-undang Islamlah yang layak dilaksana dan digunapakai di negara ini, jika kita mengambilkira jumlah penduduk majoriti,” terangnya.

Beliau berpendapat isu hudud ini menyerlahkan masalah keyakinan orang-orang Islam sendiri tentang kelebihan dan kebaikan undang-undang Islam. Mereka mempersoalkan – bolehkah undang-undang ini dilaksanakan di negara ini?

“Ini merupakan krisis keyakinan,” kata beliau sambil membidas kenyataan Naib Presiden Umno Datuk Seri Dr Ahmad Zahid Hamidi semalam yang menyatakan hukum hudud belum dapat dilaksanakan kerana masalah kesesuaian dalam masyarakat majmuk di negara ini.

Ujar beliau, “segolongan masyarakat mempunyai persepsi yang negatif dalam menangani hukum hudud kerana peranan media arus

perdana yang sering memperlekeh isu ini dan menjadi tanggungjawab kita untuk menukar persepsi negatif ini kepada positif.”

Kamal Koh menyoal, “apabila Allah SWT mewajibkan pelaksanaan hukum hudud, adakah Allah tidak tahu di Malaysia ini terdapat

masyarakat majmuk, yang terdiri daripada orang-orang Melayu, Cina, India, Iban, Kadazan dan lain-lain?

“Adakah Allah tidak tahu tentang perkara ini? Bukankah Allah yang mencipta masyarakat majmuk itu dan Dia juga yang mencipta hukum hudud?,” soal beliau lagi.

Seperti takut hantu

Katanya, sebenarnya mereka yang menentang hukum hudud adalah seperti kata (Menteri Besar Kelantan, Tuan Guru) Datuk Nik Aziz (Nik Mat), “takut hudud seperti takut hantu.”

“Orang yang tidak faham hukum hudud atau tidak mengenal hantu, akan menentangnya secara membabi buta,” kata Nik Aziz.

Menurut Kamal Koh, penentangan Pengerusi DAP Karpal Singh juga tidak mempunyai asas kerana Nik Aziz mengumumkan bahawa pelaksanaan hukum hudud di Kelantan akan diletakkan di bawah bidang kuasa Mahkamah Syariah.

Sebuah akhbar arus perdana semalam melaporkan bahawa Nik Aziz berkata kerajaan negeri mahu melaksanakan undang-undang itu melalui sistem mahkamah syariah.

Ini ekoran dari sidang Dewan Undangan Negeri Kelantan yang telah meluluskan Enakmen Undang-undang Jenayah Syariah (II) 1993 (Hukum Hudud) dan hanya menunggu masa untuk dilaksanakan.

Dari sudut Perlembagaan Persekutuan juga menurutnya, tidak menghalang pelaksanaan hukum hudud dan qisas seperti mana yang disuarakan oleh pakar perlembagaan dari Universiti Islam Antarabangsa, Profesor Dr. Aziz Bari.

Menurut Aziz Bari, undang-undang Islam termasuk hudud dan qisas boleh dilaksanakan di Malaysia kerana perlembagaan tidak menghalangnya.

Kamal Koh juga mempersoalkan mengenai undang-undang negara yang diterima pakai sekarang ini sebagai warisan dari sistem undang-undang penjajah British.

“Negara kita seolah-olah belum merdeka kerana masih terikat dan terpaksa menerima pakai undang-undang penjajah (yang digubal oleh Lord Reid) yang dianggap sesuai untuk masyarakat majmuk dan undang-undang itu berkuasa (supreme) atas segala-galanya,” tegas beliau.

Kamal Koh juga menyarankan supaya kesedaran politik Islam dipertingkatkan di kalangan orang Melayu-Islam sendiri dan orang-orang bukan Islam juga harus diberi penerangan dan kesedaran tentang betapa indahnya undang-undang ciptaan Ilahi ini.

Nik Aziz pernah menyifatkan undang-undang Islam ini seperti nasi beriani. Orang-orang yang hanya makan nasi biasa tetapi tidak pernah makan nasi beriani tidak akan tahu betapa nikmat dan lazatnya nasi beriani.

Anwar clarifies his hudud stand
Teoh El Sen | September 24, 2011 The Opposition Leader condemns Umno and Barisan Nasional for exploiting the hudud issue for political mileage.


PETALING JAYA: Opposition Leader Anwar Ibrahim has given an assurance that Pakatan Rakyat would discuss the hudud issue to seek an amicable solution in an attempt to clarify his earlier controversial statement in support of Kelantan implementing the Islamic laws.

“I would like to stress that Pakatan Rakyat is a coalition built on the principle of consensus and mutual trust and respect,” said Anwar during a speech in Terengganu. The speech was issued to the media by PKR headquarters here.

“We hold firm to the conviction that any issue which affects the interest of the people must be discussed frankly in a civilized manner with the objective of seeking an amicable resolution.”

Anwar said Pakatan believes that each and every component party of the coalition should be given its legitimate right to explain its position on significant issues to its members.

He added that in relation to the PAS state government’s intention to implement hudud in Kelantan, his view was that “we should respect that decision, but certainly it would depend on several things.”

He said the implementation of hudud in Kelantan must, in all circumstances be subject, to the maqasid al Shari’a (the higher objectives of the syariah), in which it was “most paramount” to ensure justice for all, regardless of race, status or religion.

“This warrants the existence of syariah judges who are capable of dispensing justice without fear or favour and a syariah judicial system which is independent of political pressure or other kinds of influence that would impair its functions in the administration of justice,” he said.

Anwar said that he, as a Muslim, was bound by the commandments of his religion, including the injunctions as ordained in the Quran, but stressed that non-Muslims are and must continue to be in all circumstances exempt from the syariah laws.

“As I have stated before, the right to practice one’s faith is a fundamental freedom that is guaranteed by the Federal Constitution,” he said.

Umno/BN hypocrisy

He added that this was in line with the position of the Pakatan Rakyat as laid out in the Orange Book, which stated:

“…to defend the Federal Constitution, to uphold the position of Islam as the religion of the Federation, to ensure that other religions may be professed and practiced fully, and to safeguard the special position of the Malays and the natives of Sabah and Sarawak as well as the interests of other races in line with Article 153.”

Anwar condemned “the hypocrisy of Umno and Barisan Nasional in exploiting the hudud issue for political mileage”.

“Even more deplorable are the sinister machinations orchestrated by Umno in attempting to stoke the fires of ethnic and religious tension by repeatedly playing up the issue in their media,” he added.

Anwar said on one hand, BN was projecting an anti-syariah stance to the non-Muslim audience, even on some occasions rubbishing it as a primitive system; while to the Muslim audience, they relentlessly attack Pakatan Muslim leaders as being traitors to their religion and race by consorting with non-Muslim leaders.

“Without doubt these actions are part and parcel of the overall plan to drive a wedge in the Pakatan coalition and bring about internal strife and in the process hope to weaken the coalition and the chances of victory in the next elections,” he said.

In recent days, Pakatan has been rocked by Anwar’s statement last Thursday that he would support the implementation of hudud in Kelantan. He however was quick to add that it was his personal stand, and did not reflect Pakatan’s view.

DAP however was not impressed by Anwar’s remarks, hitting out at him for making such a pronouncement.

KAMPAR: The Government will not implement hudud law in Malaysia, said Prime Minister Datuk Seri Najib Tun Razak.

He said even though the law was "God's law", its implementation needed to be based on realities.

"If we ask the ulamas, Islamic law cannot be implemented unless we take into consideration the environment and the reality.

"Moreover, the aim of an administration according to Islam is based on maqasid syariah, which entails protecting the religion, life, moral and property, among others," he told reporters after launching the Tanjung Tualang 1Malaysia carnival here Saturday.

The Prime Minister said under the current laws, the principle and objective of maqasid syariah could be championed.

Asked if this meant that hudud law need not be practised in Malaysia, Najib said there were already elements of hudud in the system but "minus the extreme part".

"This does not mean there are no Islamic laws being practised in Malaysia," he said.

Bear down on recalcitrant drivers

THE just concluded Ops Sikap saw a record high fatality rate of 289, and also saw the issuance of an average of 2,000 summonses a day to motorists flouting the highway code.

Statistics-wise, it’s scary and alarming, giving an indication of the disgraceful way we drive on the roads, not only during festive seasons but also on a daily basis.

The days when traffic offenders would feel awfully sorry for breaking the highway code, and having to pay for doing so, are gone. The new attitude is: “who cares and what does it matter”.

And since they are not in any way being “inconvenienced” for non-settlement of summonses, and summonses are seen “payable when able and at favourable times”, recalcitrant traffic offenders would continue flouting the law and collecting more summonses, making a mockery of the system.

With the ever increasing vehicle population on the road, accidents and fatalities are bound to also rise unless serious thought is given to the matter.

As motorists have proven not receptive to various road safety campaigns, the only option is strict enforcement aided by modern technologies, not only during festive seasons but also daily throughout the year.

If other countries can impose law and order to make their roads much safer, we too can do it true to the tag “Malaysia Boleh”. And half the battle is won if there is this important factor – political will.
